1.1. These terms and conditions govern the use of our photography and videography services and website. By engaging our services or accessing our website, you agree to comply with these terms and conditions.
2.1. We offer professional photography and videography services for various occasions, including but not limited to weddings, portraits, events, and commercial projects.
2.2. Our services may include photography sessions, video sessions, editing, printing, and digital delivery of images as specified in the service agreement.
2.3. We reserve the right to refuse service to any client for any reason.
3.1. To book our services, a non-refundable deposit of 50% of the total amount is required to secure the date and time of the photography and/or videography session 21 Days prior to the session commencing.
3.1.1. If a booking is made within 3–5 days before the photography session or videography session, a 75% deposit will be required to secure the date and time of the photography and/or videography session.
3.2. The remaining balance is due 7 Days before the day of the photography/videography session unless otherwise agreed upon.
3.3. Payments can be made via cash or bank transfer.
3.4. Prices are subject to change without prior notice but will not affect confirmed bookings.
3.5. Late Payment and Interest on Outstanding Invoices. In the event that an invoice remains unpaid or has an outstanding balance after the due date, an interest rate of 2% per month (compounded monthly) or 24% annually, will be applied to the outstanding amount until fully paid. This is in addition to any other rights or remedies available to us under these terms or applicable law.
4.1. In the event of cancellation by the client, the deposit will not be refunded.
4.2. Cancellations made within 3–5 days of the scheduled session may result in additional charges.
4.3. We reserve the right to cancel or reschedule sessions due to unforeseen circumstances such as weather conditions or equipment failure. In such cases, we will make every effort to reschedule at a mutually convenient time.
5.1. All project files, source materials, videos, graphics, and any other deliverables or working files (“Project Materials”) will be retained by the Company for a maximum period of six (6) months from the date of final delivery or project completion, whichever occurs later.
5.2. After the expiry of this six-month period, the Company will permanently delete all Project Materials without further notice. If the Client wishes to retain any Project Materials beyond the initial six-month period, the Client must notify the Company in writing before the six-month period ends and agree to pay a storage fee of R480 per month (or part thereof), billed in advance. Storage is provided at the Company’s sole discretion, subject to available capacity, and may be withdrawn with 30 days’ notice.
5.3. The Company shall not be liable for any loss, corruption, or inability to retrieve Project Materials after they have been deleted in accordance with this policy.
6.1. The copyright of all images and video footage remains with the photographer. Clients are granted personal usage rights only.
6.2. Images and/or videos may not be altered, sold, or published without the explicit permission of the photographer.
6.3. We reserve the right to use images and/or videos for promotional purposes, including but not limited to our website, social media, and marketing materials, unless otherwise agreed upon with the client.
6.4. RAW files are not included in any package and remain the sole property of Ross Motion Media. RAW files are unedited and not representative of our final work. If a client requests access to RAW files, this may be approved at our discretion and will incur an additional fee. Pricing for RAW files will be provided upon request and must be paid in full prior to delivery.
7.1. While every effort will be made to deliver high-quality images and high-quality videos, we cannot be held liable for factors beyond our control, such as the behavior of subjects, environmental conditions, or technical issues.
7.2. In the unlikely event of total photographic failure and/or video failure, our liability shall be limited to a full refund of all payments received.
7.3. We recommend clients have appropriate insurance coverage for their events or projects.
8.1. We respect the privacy of our clients and will not disclose any sensitive information without their consent.
9.1. These terms and conditions shall be governed by and construed in accordance with national law.
9.2. Any disputes arising out of these terms and conditions shall be subject to the exclusive jurisdiction of the courts in our vicinity.
10.1. We reserve the right to amend these terms and conditions at any time. Any changes will be effective immediately upon posting on our website.
